USA’s Ninth Circuit Introduces Speciality H1B Visa for Programmers

  • Programmers are now eligible for the H1B Occupation Visa


IT companies are inviting Computer Programmers from India and other countries to the US by sponsoring them for the Speciality H1B Visa. Prior to this decision passed by the American Court, Computer Programmers did not fall under the ‘Speciality’ Category for the H1B occupation visa.

The newest law enables computer professionals to work and settle in the U.S based on their skills and expertise. The definition for a special vacancy presented by the court is, “theoretical and practical application of a body of highly specialised knowledge”.

Cyrus D Mehta, the founder of a New York-based immigration law firm, told Times of India: “The decision is a refreshing rebuttal to USCIS’s longstanding practice of challenging computer programming on specialty occupation grounds...”
